Call to Action! Submit Comments on the Companionship Exemption Proposed Rule and Contact Congress Today!

Last month President Obama and the U.S. Department of Labor (DOL) called for an end to the companionship services exemption for home care workers, which would require overtime pay and minimum wage for companion workers providing non-medical care to clientsat home. HCAF opposes removing this exemption as it will result in increased costs for providers, reduced availability of care and higher costs for patients and less compensation for the workers providing the services.

The DOL released on December 27 its proposed rule to remove the exemption for home care workers. HCAF will submit comments on behalf of the Florida home care industry detailing its opposition to removing the exemption, but we encourage providers to submit comments as well.

If you would like to make an official comment on the DOL proposed rule, you can do so through the Federal eRulemaking Portal. Comments must be received on or before February 27, 2012. In order to leave a comment, follow these steps:

  • Visit
  • Click the “Search for a Proposed Rule” button
  • Enter “companionship exemption” in the keyword field
  • Select “Application of the Fair Labor Standards Act to Domestic Service”
  • Click the “Submit a Comment” button and enter your comment

Call to Action

Congress has the authority to intervene and keep the companionship services exemption in place. We must do everything we can to prevent changes to the companionship services exemption that will adversely affect the home care industry!
